Adult Entertainment And First Ammendment Rights The essence of the American dream stems from freedom. Before this nation was even called the United States of America, religious separatists ventured across the Atlantic Ocean so that they would be free to practice a religion that was not controlled by the state. Today, we find ourselves in a constant battle with ethics, morals and values in the United States. Seeing that we are a nation that is culturally diverse myriad of cultures and religions has been mixed together and the final outcome is the society that we live in today. A serious conflict between the morally correct and the ethically deficient is the topic of sex and sexuality. Most of the arguments against adult entertainment stem from the belief that it is morally wrong. Maybe in another country where a certain distinct religion was the foundation of our beliefs I would be less likely to fight these ideas. However in the United States the mixture of different cultures, belief systems, and constitutional rights allows me to think that people should be allowed to chose what they want to believe. Recently, Orange County Sheriffs in Central Florida raided and now are threatening to shut down Rachels Mens Club. Of course the reason behind the closing down of the club has substantial legal grounds. The only reasons this club should be shut down are because of the sale of drugs on the premises and illegal sexual conduct occurring with the dancers. Unfortunately, business such as Rachels are at a disadvantage because of the type of services they are providing to the public. It is hard to believe someone that you know is involved with something that isnt the easiest service to explain to your children. On the other hand, it isnt fair for the owners of these establishments to make a good living because they are constantly fighting against the onslaught of protesters that believe that this type of service and activity is immoral and that it should not take place anywhere. These people have the absolute right, based on the first amendment, to voice their opinions without question, but to place a person at a disadvantage because they own a certain type of business is against the foundations on which our nation was established. Current laws in Seminole and Orange counties prohibit adult entertainment establishments from being located within one mile of any residential area. Further, recent changes in county codes have limited full nudity in Seminole County. Having instituted this law prior to the foundation of an adult entertainment facility in the county it is fair to say that any business man would have equal opportunity to commercial property that is within the boundaries that the law requires. Unfortunately to better suit the growing nature of society residential areas expand quickly and sometimes without regard to these businesses that were founded legally. Should these business be forced to move because the residence moved closer to them or should the residences have foreseen this matter before it occurred? In New York City, Mayor Rudolph Guliani believed that since citizens moved into the area and the business were creating a public nuisance they should be shut down. In 1998, the adult entertainment facilities of Times Square, New York were forced to shut their doors. Instead of silhouettes of women lighting up the night sky, the famous Mickey Mouse silhouette would gleam across the horizon. Should Americans be forced to live by the same kind of morals and ethics deemed politically correct by the government? Is the Disney Corporation the standard the way that everyone should live their lives? In 1993, Disneys Buena Vista Studios produced The Program. The movie deals with issues that effect the lives of many young Americans such as sex, sports, social life, alcohol, and peer pressure. One scene in particular came under great scrutiny and when the film was released on VHS it was removed from the film. The scene involves several of the main characters that decided that they would lie in the middle of a busy road as part of a dare. SMC is a company that manufactures ergonomic office equipment in need of organizational restructuring in order to meet an increase in demand. Our main areas of concern will be the manufacturing, operations and customer service areas that will receiving restructuring. Due to the fact that the demografic around SMC is 90% caucasion, the company will address affirmative action issues and set goals within the company to fulfill requirements. In addition, SMC will use new recruitment methods such as cross-training, job shadowing and electronic recruitment in the company’s local intranet. These changes in leadership and recruitment should position SMC to be able to handle and maintain high levels of demand. Due to a 100% increase on production demand, SMC will implement a staffing plan to accommodate the increase in supply and demand and successfully deliver products to its client base. The main departments affected in the staffing plan are Manufacturing, Operations, and Customer Service. Analysis of labor supply and demand found corporate changes will be needed, which include, but not limited to, creating new positions, upsizing production staff and offering internal promotions to the current staff. These changes are necessary for SMC to meet the current demand and prepare for future growth. Upon evaluating the workforce utilization of the exiting labor force, SMC HR found the company does not comply with affirmative action requirements. SMC HR will set goals and timelines for meeting compliance and bring the company out from underutilization. HR will use employment agencies that provide a diverse employee pool in which to choice their talent. The current need for upsizing will be an opportunity to hire from a broader labor pool and bring in more diversity; this will assist in growing a healthy company. SMC HR determined in order to make the current demand successful the Manufacturing Department will require two full time supervisors, one for the day shift and one for the evening shift, along with six Team Leaders. Customer Service will require an additional two employees to help field calls due to the increase in customer base. With new leadership and approximately 30 new line employees, the company’s employee appearance will change dramatically. The Manufa cturing Department will require the creation of further Team Leader positions. The Team Leaders will handle training the temporary production workers, setting schedules to assure production goals and deliverables are on schedule. The ratio of Team Leader to line worker will be 15 to 1. Two Supervisors will now lead manufacturing to support the increase in employees. These changes will position the company for future expansion over the next year, which the HR forecast predicts. Another change the HR department is initating is for the first time in company history, employees will be cross trained in multiple work centers in the plant. The changes will increase the company’s recourses and make SMC prepared for unexpected situations which may arise that affect deadlines. In addition, these changes give the existing SMC staff an opportunity for advancement and job growth. Promoting from within makes the company a more desirable place to work and the company will most likely retain its experienced employees. Offering job advancement saves the company time and money; both commodities the company cannot afford to lose with the current expansion. This overhaul in organizational structure also builds morale with the current staff and makes them more willing to train and work with the new employees. Hiring temporary staff will be an important piece in the HR plan. Since hiring new employees is timely and expensive, it will benefit the company to pull from a temporary pool. After an evaluation of the temporary staff’s job performance, the top performers will position themselves for permanent positions with SMC. The temporary pool will be a good resource to pull skillful talent into the company after they have worked for 90 days as contract employees. The plan will evaluate trends that will continue in the future and accordingly hire permanent employees in the short term. Upon forecasting the demand for labor through trend analysis, the company can meet the increase in production goals by offering overtime to current employees. Overtime will reduce the number of new hires and training time. Historically the current staff has shown great interest in overtime pay and performed exceptionally well. Leading indicators also predict the company will need to increase current staff by 50% in all departments over the next year to accommodate future growth. Determining labor supply reflects the current labor force. Since the company has minimal turnover and does not anticipate downsizing. With the necessary leadership in place, the company will reach the goals and not lose quality or customer service. At SMC, the increase in demand for our ergonomic office equipment requires management to come up with an employee recruitment strategy that focuses on quickly providing qualified staffing solutions. The SMC’s human resources (HR) consultant, who collaborates with the management staff, will follow a formal employment process that provides procedures for posting, advertising, interviewing, selecting, hiring and orienting the new employee. The HR consultant’s role in recruitment is crucial because the individual serves as a strategic business partner to senior management. HR also provides guidance in determining the most effective and efficient recruitment and retention strategies, as well as other facets of personnel-related matters. The postings on the intranet site are a cost effective tool to help with the increase in demand for staffing. Internal applicants that receive poor performance evaluations and have a negative employee history do not qualify for interview status. In conclusion, SMC will increase the demand of output needs by 100%. SMC will implement an organizational restructuring in order to meet the increase in customer demand. The following departments manufacturing, operations, and customer service will be restructured to benefit SMC’s employee efficiency and effectiveness. SMC will increase staff by 50% in all departments over the next year to accommodate future growth. SMC staffing plan will accommodate the necessary staff for the needed departments by implementing an organization chart for each department. The Staffing plan will consist of cross-training, hiring second shift manager, and reorganizing employees to team leads for leadership. The Staffing plan will create opportunities for consciousness employees to grow within the organization. SMC will announce the need for new hires through the company’s Intranet, Temp Agency, Radio Station, Newspaper and Job Fairs as recruiting strategies. Joint venture is important for MOS Burger and successfully using by MOS to expand their business to overseas regions including Taiwan, Hong Kong, Singapore and others. The successful of this strategy can be seen in Taiwan which consist the highest number of outlets among the foreign markets. According to Charles and William (2011), franchising considered as a specialized form of licensing in which franchiser sell the intangible property to the franchisee and insists on rules to do the business. MOS burger expands their business and increase the number of outlet out of their home country by seeking large franchisees instead of seeking the small scale or individual capacity (MOS Burger Website, 2012). Within every single region, those individual franchisees will be managed by the joint venture company together with MOS Burger to make sure all franchisees perform according to the established business practice and ensure the quality control in term of food as well as their customer service. MOS Burger can partner with the petrol station such as Petronas, Shell or etc. This proposed entry mode is derived from other fast food firm such as Pizza Hut and Taco Bell. The Pizza Hut and Taco Bell have created a strong partnership and this is a successful cooperation (Co-branding examples, 2012). According to Onakayo (2003) the managing director of Mobil Oil, Mobil petrol station has a fast food court called On The Run and it provide family or friends to enjoy in a comfort and quality place. Besides, Dr. Paa (2003) said that partnership of fast food with petrol station provide benefits to customers, share holders as well as the overall economy of a cities or places. Besides, the practice of this strategy can benefits those long journey travelers who use the South-North Expressway especially those from Singapore to North areas need to pump in the petrol and take a rest during their journey or half way. Dr Paa (2003) also said that this practice can commend as a tourism attraction because it able to serve the travelers need who moving around and between cities. Once this partnership has been implementing, after the traveler pump in the petrol they can take a rest while will enjoy their meal just beside the petrol station only. This will open-up a new opportunity for the MOS Burger while also will attract the traveler for particular petrol station to fill up fuel and rest. The dairy industry in New Zealand is famous and distinctive in term of its high quality and flavorful products. Besides, according to the statistic New Zealand (2011), milk powder, butter and cheese are the top one as well as meat and edible offal as the top two commodities that exported by New Zealand. The company will choose a suitable franchisees or partners that know well and align to the MOS Burgers philosophy to cooperate. This is to make sureÂÂ  that the risks of enter into a different market for doing business can be reduce and to maintain a substantial control over the quality of the food. Moreover, choosing the right partners is to ensure that the commitment of the company can be transmit to those who like to eat MOSs burger. Besides that, MOS Burger can expand their business using other entry modes as well in the future to compete with their rivals in foreign markets. Exporting is another alternative for MOS as it is the easiest way for the company to enter the new markets and reach the customers easily. The company is suggest to export their product in term of snack form by using the well established brand name MOS Burger to enter the Canadian market which has a high consumption of snack food. Meanwhile, the partnership entry mode can be adopted as well in Malaysia by cooperating with local well known company for example Petronas. MOS can partner with the petrol station distributor to build their outlets beside or near the petrol station along the South- North Highway in Malaysia to gain benefit while the travelers take their rest or refill petrol at the petrol station on the highway. Next, the company can also use the backward integration strategy to gain some advantages on the cost of material and als o to strengthen the supply chain system of the company which need not depends much on the main suppliers anymore. This can be done probably in New Zealand by acquiring a piece of land and breed their own poultry that needed for making the burgers. Finally, MOS Burger is a company that has a potential to expand and grow globally. Thus, it need to be managed by a talented and committed management team and also maintain a good cooperation with his partners and franchisees.

Law Makers Have Become Law Breakers in India Essay

I am sure that most of us would be reading newspapers or listening to news on radio or TV. And more often than not, one of the headlines these days cover a scam or corruption conducted by the very people who have been entrusted with a responsibility to make or protect the laws of the land. And sadly, the extent of such transgressions is increasing with each passing day. In the wake of such woeful commentary on the state of affairs in our country, I am bound to be one with the fact that â€Å"Law Makers are now Law Breakers†. The rot of our society has been going on for years and we kept looking the other way. Power started acting as a catalyst or disease, transforming simple human beings of honest backgrounds into demons devoid of honor. They started eating up our ethos and we still looked the other way. Criminals supported these corrupt public servants to get their raunchy ways covered up. But now criminals have stopped stooping over such people. They themselves are now becoming law makers. And the sorry state is that we have started living with this disgracive turn of events. BUT for how long. Isn’t it time we put down our foot and stop this before it eats up our society. The below data could cause shivers amongst most of us. Of the 545 current Lok Sabha MPs, over 30% have criminal cases against them – 67 of them facing serious charges of murder, rape and extortion. Out of approx. 4000 sitting state MLAs over 31% are muddied with criminal cases against them. And the story doesn’t end here. A survey on Asian officialdom notes that Indian bureaucracy is the worst in Asia. More and more bureaucrats are getting indicted in gross misuse of power for their ulterior motives. The number of complaints received against police officials in 2011 stood at a whopping 61700 (that is over 170 complaints every day). Needless to say, only 18% of these complaints were converted to registered cases. So the question now is – Have all law makers become Law Breakers. The fact sadly is that perhaps not all but WAY TOO MANY. But what’s the solution. Is there any Perhaps not†¦at least not till WE reform ourselves. The fact is that we, Indians, have lost the virtue of truth and honor in  ourselves, More often than not, we have adopted our famous â€Å"chalta hai† culture – whether it is in driving on roads, or filing our IT / Sales Tax returns or filling up a simple application form for a new job. We have lost the value of truth. We have lost the value of LAW. If we do not value integrity and honesty in ourselves, we will not value these qualities in our Law Makers. We will keep on electing such corrupt and tainted representatives and hence choose this â€Å"Law Breaking† tendency to permeate in our society. In any job, even to get appointed as a teacher in a private school, a reference check is conducted to ensure that no person with a tainted or criminal background is recruited. However no such check is conducted by our political parties while finalizing its list of its candidate. The main criteria, there, is not their ethics or morale, but their â€Å"ability to spend money† and â€Å"their ability to win†. This has to be changed and fast. Kudos to the Supreme Court in India, it ruled that any person convicted should be immediately debarred from his parliamentary seat and also from contesting elections. I hope that political parties would see great sense in it and apply this in letter and spirit. And in case our leaders do not see value in this judgment, we should force them to see it. We should STOP casting our vote to such people which checkered backgrounds. We all, have to take some affirmative steps to stop this rot of Indian ethos. We have to vow to stand up, in whatever small way we can, against this rapidly flourishing weed of â€Å"Law makers becoming Law breakers†. We should STOP giving and accepting bribes. We should STOP hiding our true income. AND we should STOP accepting flouting of laws by anyone. We should STAND UP and RISE, against anything that is unethical and unlawful. This is not easy and may take more time than what we might assume. But, believe me, this is the ONLY way to stop the degradation of our rich past and our righteousness.

Participant observation is where the researcher joins the group or community they are studying, the researcher will participate in the activities over a period of time, to do this, the researcher attempts to become accepted in order to collect more valid research and to try and see the world in the way the group does. There are two types of participant observation, Covert and Overt.Covert participant observation is where the researcher will take an undercover role in order to do research into the group they wish to study, there is normally a ‘gate keeper’ within this group that knows the researcher is there to do research, the gate keeper helps get them into the group to do this research. Overt participant observation is where the researcher takes a more open role; they openly ask the group if they will allow the researcher to study them.Interpretivists prefer participant observations as they argue that it’s the most effective way to understand the meanings people give on certain things, they also prefer it as there is a greater chance of developing their understanding further by verstehen. An advantage of covert participant observation could be that more valid research will be gained as they study is true to life when compared to overt research. With overt participant observation there can be a risk of less valid data due to the Hawthorne Effect; this is where the presence of the researcher can affect the way the participants behave.With both covert and overt participant observations rapports can be made which may lead to more valid data and data that is normally hard to reach as the group that the researcher is studying will begin to trust them. However, this can take time and can be less practical. An example of this is Eileen Barker’s study on the Unification Church, she studied the ‘Moonie’s’ over 7 years, gaining the trust of the participants, who soon saw her as a friend, thus enabling her to gain more valid and truthful research.By doing this, Barker gained verstehen meaning she could understand the feelings of the people she was studying, empathising with them; as a result she developed a further understanding of their way of life. Other practical issues with covert participant observation are that it can be hard to find a gate keeper to let the researcher into the group. Both covert and overt research are very time consuming and cost a lot, so the study must be worth the time of studying.Both covert and overt observations can be low in reliability as they are hard to replicate and get consistent results. Researchers may remember and interpret things differently thus reducing the reliability of the research even further. This tends to be more of a disadvantage with covert research as they are unable to write down everything the group being studied says as it will risk their cover and could ruin the research.With an overt role, this can be avoided as they are able to take notes in the open, and can use different types of methods such as interviews or questionnaires. Covert participant observation tends to be more unethical than overt participant observation as the researcher doesn’t ask the group for consent thus deceiving the group, the researcher may take part in illegal acts in order to maintain cover, an example of this is Patrick, he studied a gang in Glasgow over four months, during his time in the gang he was required to partake in burglaries to keep the trust of the gang.To prevent this, researchers may want to take more of an overt role, which means they have an honest and open role within the group, meaning there is no deception and they won’t have to take part in illegal acts. Positivists don’t like participant observation as it’s hard for them to gather quantitative data, so they aren’t able to generalise or see patterns or trends.
